Terms of Service

These terms form an agreement between you and Mediabox LLC covering your use of the INKtoon website and application. By installing the application or using this website, you accept them.

1. The parties and the agreement

These Terms of Service ("Terms") govern your access to and use of this website and the INKtoon mobile application for iOS (id6761719008) and Android (com.comicverse.reader), together the "Service". The Service is provided by Mediabox LLC, registered in the State of Wyoming, United States under number 2017-000746900, of 109 E 17th St, STE 430, Cheyenne, WY 82001, United States ("we", "us").

If you do not agree to these Terms, do not install or use the Service.

2. Eligibility

The Service is rated 16+. You must be at least 13 years old to use it. If you are under the age of majority in your country, you may use the Service only with the knowledge and involvement of a parent or legal guardian, who accepts these Terms on your behalf.

3. Licence to use the Service

We grant you a personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and run one copy of the application on a device you own or control, and to read the content made available in it for your own personal, non-commercial use.

This licence lasts for as long as you comply with these Terms and ends automatically if you breach them. All rights not expressly granted are reserved.

4. Acceptable use

You must not:

• copy, download in bulk, scrape, mirror, republish, redistribute, sell, rent, sublicense or publicly display any content from the Service;
• circumvent, disable or interfere with security features, access controls, rate limits or content protection;
• reverse engineer, decompile or disassemble the application, or attempt to derive its source code, except to the extent that applicable law expressly permits this and only after you have asked us for the information you need;
• use bots, crawlers or other automated means to access the Service, or send it more requests than a human user could reasonably generate;
• remove, obscure or alter any copyright, trade mark or other proprietary notice;
• use the Service to infringe anyone's rights, or for any unlawful, deceptive or harmful purpose.

We may suspend access where we reasonably believe conduct of this kind is taking place.

5. Content and intellectual property

Comics, artwork, text, translations, lettering and other material available in the Service are protected by copyright and related rights and remain the property of their respective rights holders. They are made available to you under agreements between us and those rights holders or their authorised distributors.

The INKtoon name, logo and the software itself are owned by Mediabox LLC. Nothing in these Terms transfers ownership of anything to you.

If you believe material in the Service infringes your copyright, the process for telling us is on the Copyright page.

6. Availability of titles

Which titles are available depends on our agreements with rights holders and on the territory you are in. Titles may be added or withdrawn, and a title that was available when you started reading may later become unavailable. We are not liable to you for the withdrawal of a title.

7. Accounts

You can browse and read without an account. If you create one, you are responsible for keeping your credentials confidential and for activity carried out under your account. Tell us at support@mediaboxllc.com if you believe your account has been accessed without your authorisation.

You may ask us to delete your account at any time by writing to support@mediaboxllc.com. We action deletion requests within 30 days.

8. Changes to the Service

We may add, change, suspend or discontinue features, or the Service as a whole. Where a change removes a material feature, we will give reasonable notice in the application unless the change is required for legal or security reasons. We do not warrant that the Service will be uninterrupted, timely or error-free.

9. Termination

You may end this agreement at any time by uninstalling the application and ceasing to use the website. We may suspend or terminate your access, with notice where practicable, if you materially breach these Terms, if we are required to do so by law, or if continuing to provide the Service to you would expose us to legal liability. Sections 5, 10, 11, 12 and 16 survive termination.

10. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", and we exclude all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. If you are a consumer, your statutory rights are not affected.

11. Limitation of liability

To the maximum extent permitted by applicable law, Mediabox LLC will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, goodwill or anticipated savings, arising out of or in connection with the Service, however caused and on any theory of liability.

Where liability cannot be excluded, our total aggregate liability arising out of or in connection with these Terms is limited to USD 100 or the amount you have paid us in the twelve months before the event giving rise to the claim, whichever is greater.

12. Indemnity

You agree to indemnify us against reasonable losses, liabilities and costs we incur arising from your breach of section 4 or section 5, or from your unlawful use of the Service. This section does not apply to you if you are acting as a consumer.

13. Third parties

The application is distributed through the Apple App Store and Google Play, and your use of either store is subject to that store's own terms. Neither Apple nor Google is a party to these Terms, and neither has any obligation to provide support for the application. The Service also relies on the third-party providers described in our Privacy Policy.

14. Feedback

If you send us suggestions about the Service, you grant us a non-exclusive, royalty-free, worldwide licence to use them without obligation to you. We do not treat feedback as confidential, so please do not send us anything you consider confidential.

15. Notices

We may give you notice through the application, on this website, or by email if you have given us an address. You may give us notice at support@mediaboxllc.com or at the postal address in section 1.

16. Governing law and disputes

These Terms and any dispute arising out of them are governed by the laws of the State of Wyoming and, where applicable, the federal laws of the United States, without regard to conflict-of-law rules. The state and federal courts located in Laramie County, Wyoming, have exclusive jurisdiction, and you and we consent to their personal jurisdiction and venue.

If you are a consumer resident in the European Union or the United Kingdom, you keep the protection of the mandatory provisions of the law of your country of residence and may bring proceedings in your local courts. We encourage you to contact us first at support@mediaboxllc.com so that we can try to resolve the matter directly.

17. General

If any provision of these Terms is found to be unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger or sale of assets. Neither party is liable for failure to perform caused by events beyond its reasonable control. These Terms, together with the Privacy Policy, Cookie Policy and Copyright page, are the entire agreement between us in relation to the Service.

18. Changes to these Terms

We may update these Terms. The date at the top of the page shows when they were last changed. Where a change is material, we give notice in the application or on this website before it takes effect. If you continue to use the Service after that, you accept the updated Terms; if you do not accept them, stop using the Service.
