Copyright and DMCA
Mediabox LLC respects the rights of creators, publishers and translators. This page sets out how to notify us of material you believe infringes your copyright, what we do when we receive such a notice, and how to challenge a removal.
1. Our position
Comics made available in INKtoon are licensed from rights holders or their authorised distributors. If material has nonetheless been made available without the necessary rights, we want to know, and we act on properly substantiated notices.
We accept notices from rights holders anywhere. The procedure below follows section 512 of the United States Copyright Act (the DMCA) and we apply the same process to notices under Article 17 of Directive (EU) 2019/790 and equivalent national law.
2. Designated agent
Send copyright notices to our designated agent:
Copyright Agent
Mediabox LLC
109 E 17th St, STE 430, Cheyenne, WY 82001, United States
support@mediaboxllc.com
Notices sent to other addresses may take longer to reach the right person. Please use the subject line "Copyright notice".
3. What a notice must contain
To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:
- Your full name, postal address, telephone number and email address.
- Identification of the copyrighted work you claim has been infringed — the title, and where available registration or publication details. If you are notifying us about multiple works, a representative list is sufficient.
- Identification of the material you are asking us to remove or disable, precise enough for us to locate it: the title as it appears in INKtoon, and the chapters or pages concerned.
- A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner's behalf.
- Your physical or electronic signature.
An incomplete notice may delay our response, because we may need to come back to you for the missing element before we can act.
4. How we handle a notice
- We acknowledge receipt within 2 business days.
- Where the notice is complete and valid, we remove or disable access to the identified material expeditiously, and normally within 5 business days of acknowledgement.
- We notify the party that supplied the material, provide them with a copy of your notice, and inform them of their right to submit a counter-notice.
- We record the notice, the material concerned and the action taken, and count it towards that party's record under section 6.
- If we decline to act, we tell you why, so that you can decide how to proceed.
5. Counter-notice
If material you supplied was removed and you believe that was the result of a mistake or a misidentification, you may send a counter-notice to support@mediaboxllc.com containing:
- Your name, postal address, telephone number and email address.
- Identification of the material that was removed and the location at which it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located — or, if your address is outside the United States, the United States District Court for the District of Wyoming — and that you will accept service of process from the person who submitted the original notice.
- Your physical or electronic signature.
We forward a valid counter-notice to the party who sent the original notice. Unless that party informs us within 10 business days that it has filed an action seeking a court order, we may restore the material between 10 and 14 business days after receiving the counter-notice.
6. Repeat infringers
We maintain a record of notices received. In appropriate circumstances we terminate accounts and supply arrangements of parties who are repeat infringers, and we may do so at once where the infringement is deliberate and on a significant scale.
7. Trade marks and other rights
For complaints about trade marks, publicity rights or other rights that are not copyright, write to support@mediaboxllc.com with a description of the right you hold, the material concerned and the outcome you are asking for.
8. Misuse of this process
Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing — or that it was removed by mistake — may be liable for damages, including costs and legal fees. If you are unsure whether material is infringing, take legal advice before sending a notice.
